By completing the booking process, you confirm that you have read and understood the following terms and conditions, accept them and acknowledge their full legal effect.

1. Scope of services

Through this website, Am Burghügel KG d. Kahn Markus & Co. provides an online platform on which the accommodation establishment can offer rooms, apartments, suites and similar accommodation for booking, and through which you can make bookings. By booking through this online service, you enter into a legally binding contractual relationship with the accommodation establishment.

From the time of your booking, we act solely as an intermediary between you and the establishment, to which your booking details are forwarded. You will receive a confirmation email, where applicable after payment of a deposit.

2. Prices

The prices on our website are highly competitive. All prices shown on the booking portal include VAT. Please note that the local tourist tax introduced on 1 January 2014 is NOT included in the prices shown. Its amount depends on the type and category of accommodation and municipal regulations. The tourist tax must be paid directly at the establishment.

3. Data protection

Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation), we inform you that the data you enter during booking, except for your credit card number, are forwarded to the accommodation establishment when you book, as they are essential for providing the service.

The data are also stored and processed electronically by Am Burghügel KG d. Kahn Markus & Co. for the purpose of sending information and/or advertising material. The data may also be forwarded to partners of Am Burghügel KG d. Kahn Markus & Co. By completing the booking, you consent to the use of your data under these conditions. You have rights concerning the processing of your data. The rights holder is Am Burghügel KG d. Kahn Markus & Co., Freisingerstraße 6, I-39038 San Candido / Innichen.

You may not distribute, use on website subpages, copy, extract, republish, upload or reproduce content or information available on our website for commercial or competitive purposes.

4. No service fee

Our service is completely free of charge to you.

5. Payment terms

Payment terms are set individually by the accommodation establishment. The applicable terms are displayed during booking and in the confirmation email.

6. Cancellation by the guest

There is no right of withdrawal under the Consumer Code. Nevertheless, we grant the following cancellation terms: cancellation is free of charge up to one month before arrival. From one month to two weeks before arrival, the cancellation fee is 35% of the total price; from two weeks to one week before arrival, 70%; within the last week before arrival, 90%; and in the event of early departure, 100%.

The deposit (caparra) paid before arrival is retained in the event of cancellation.

7. Disclaimer

No liability is accepted for incorrect or untrue information published on the portal concerning accommodation establishments, including prices and availability. Am Burghügel KG d. Kahn Markus & Co. also cannot be held responsible for services provided by accommodation establishments, for damage connected with a stay, or for damage occurring before or after a stay that is in any way related to booking, cancellation, late arrival or early departure.

8. Miscellaneous

Unless otherwise stated, the software used for our services and/or website and made available on it, and the intellectual property and copyright in the website’s content and applications, belong to HGV Service Genossenschaft.

These terms and conditions and the provision of our services are governed by and interpreted in accordance with Italian law. The courts of Bolzano, Italy, have exclusive jurisdiction over disputes arising from or relating to these terms and conditions and our services. If a provision of this agreement is or becomes invalid, all other provisions applicable to the parties remain unaffected.
